Terms of Service

1. Agreement to terms

These Terms of Service (“Terms”) govern your access to and use of tmrk (the “Service”). By creating an account, accessing, or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to that organization.

2. The service

tmrk records your video meetings (via a recorder that joins calls or via self-recording from our desktop app), transcribes them, and generates summaries, action items, and a searchable archive. We may update, improve, or change features over time.

3. Accounts

You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account. Workspace administrators may manage members, roles, and access within their workspace.

4. Acceptable use

  • Don’t use the Service unlawfully or to infringe others’ rights.
  • Don’t attempt to disrupt, reverse engineer, or gain unauthorized access to the Service.
  • Don’t record meetings without the consent required by applicable law (see §5).
  • Don’t upload malware or content you don’t have the right to share.

5. Recording & consent

You are solely responsible for complying with all laws applicable to recording meetings and participants, including obtaining any required notice or consent. You agree to inform meeting participants that the meeting is being recorded. tmrk surfaces the recorder’s presence, but obtaining consent remains your responsibility.

6. Your content & ownership

As between you and us, you own your meetings, recordings, transcripts, and derived content (“Customer Content”). You grant us a limited license to host, process, and display Customer Content solely to provide and improve the Service for you. We do not sell your content or use it to train third-party foundation models.

7. AI features & third-party services

The Service uses third-party processors (e.g. transcription and AI model providers, cloud hosting and storage) to deliver its features. Your use of features that rely on a provider you supply (BYOK) is also subject to that provider’s terms. AI-generated output may be inaccurate or incomplete; you are responsible for reviewing it before relying on it.

8. Fees & billing

Paid plans are billed in advance on a recurring basis through our payment processor. Fees are non-refundable except as required by law. We may change pricing prospectively with notice; changes won’t affect the current paid term.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access for violation of these Terms or to protect the Service. Upon termination, your right to use the Service ends and we may delete your content in line with our Privacy Policy and retention practices.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

11. Limitation of liability

To the maximum extent permitted by law, tmrk will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits. Our total liability for any claim relating to the Service will not exceed the amounts you paid us in the twelve months before the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold tmrk harmless from claims arising out of your Customer Content, your use of the Service, or your violation of these Terms or applicable law (including recording-consent laws).

13. Changes to these terms

We may update these Terms from time to time. Material changes will be reflected by updating the effective date above and, where appropriate, by notifying you in the app. Continued use after changes means you accept the updated Terms.
